In the case of an anti-competitive agreement filed on behalf of Future Coupon (Informant) in the Competition Commission of India (CCI), the issue was against Amazon that it failed to notify the details of its combination as per Sec. 6(2) of the Competition Act. The case came before the Coram consisting of Chairperson Mr. A.K.Gupta and Members Mr. B.S. Bishnoi and Ms. Sangeeta Verma. Future Coupon contended that Amazon failed to notify certain shareholder agreements and commercial arrangements. CCI observed that Amazon deliberately suppressed the actual scope and purpose of the deal, CCI further directed Amazon to give Notice in Form II with complete information within 60 days and stated that, till the disposal of this notice, the approval order shall remain in abeyance. CCI suspended the approval for the Amazon-Future coupon deal and also imposed a Rs 202 crore penalty for failing to recognize and disclose strategic involvement in Future Retail and an additional Rs. 2 Crore penalty for making false and inaccurate representation and hiding important information.
